I had the great privilege of using Mike Powell as a mediator in a large complicated intellectual property matter. Mike was able to dig in and quickly grasp the legal issues involved. Mike did a fantastic job of using his understanding of this area of the law to help facilitate a favorable settlement. Mike worked hard and long on both parties to get the matter resolved. Mike and I met when our company’s primary trademark was being threatened by a large multi-national company. We were a small business and the thought of litigation was disturbing to say the least. Our trademark was was also the name of our company and the name our customer’s knew us by, so if we would have lost the name the consequences could have been dire. Mike stood up to the playground bullies and fought admirably for us and we prevailed. We will always be grateful to Mike for his perseverance and creativity while representing us. Michael took over a case from a departing colleague at Baker’s. He was quick to jump in and take control of a nasty situation. Despite the potential of winning the case against us he was quick to summarize the costs and time of doing so. Looking at costs in the hundreds of thousands is a sobbering thought. In effect even if we had won we would loose because we may not have be awarded costs As a result of his forthright nature we decided to settle and minimize costs and time and move forward on building business. Definately the right choice. Sometimes proving one is right or innocent is not necessarly the best choice. Deferring to agree to disagree is the better business decision. Mike got us there.
